General Terms and Conditions (GTC)<\/h1>\n\n\n\n

\u00a7 1 Scope<\/h2>\n\n\n\n

  1. These General Terms and Conditions (\u201cGTC\u201d) apply to all orders and purchase contracts concluded through the online shop shop.besteskernoel.at<\/strong> between

    \u2013 hereinafter referred to as the \u201cSeller\u201d \u2013 and the customer.<\/li>\n\n\n\n
  2. The online shop offers its products to both consumers and business customers.<\/li>\n\n\n\n
  3. Where the customer is a consumer, these GTC shall apply only insofar as they do not conflict with mandatory statutory provisions, in particular the Austrian Consumer Protection Act (KSchG), the Austrian Distance and Outward Transactions Act (FAGG), and other mandatory consumer protection legislation.<\/li>\n\n\n\n
  4. The version of the GTC applicable at the time the order is placed shall apply.<\/li>\n<\/ol>\n\n\n\n

    \u00a7 2 Product Offers and Conclusion of Contract<\/h2>\n\n\n\n
      \n
    1. The presentation of products in the online shop does not constitute a legally binding offer. It constitutes an invitation to the customer to submit an offer by placing an order.<\/li>\n\n\n\n
    2. The customer may select the desired products and add them to the shopping cart. Before submitting the order, the customer will be shown an overview of the selected products, prices, shipping costs and total amount and may correct any input errors.<\/li>\n\n\n\n
    3. By clicking the relevant order button, the customer submits a legally binding offer to conclude a purchase contract.<\/li>\n\n\n\n
    4. After receiving the order, the customer will receive an automatic order confirmation by email. This confirmation merely confirms receipt of the order and does not necessarily constitute acceptance of the customer’s offer.<\/li>\n\n\n\n
    5. The purchase contract is concluded when the Seller expressly accepts the order by email, dispatches the goods, or otherwise begins to fulfil the order.<\/li>\n\n\n\n
    6. If a product ordered by the customer is unavailable, the Seller will inform the customer without undue delay. Any payments already made will be refunded without undue delay.<\/li>\n<\/ol>\n\n\n\n

      \u00a7 3 Prices<\/h2>\n\n\n\n

      1. All prices displayed in the online shop include statutory VAT, unless expressly stated otherwise.<\/li>\n\n\n\n
      2. Shipping costs may be added to the purchase price. The applicable shipping costs will be displayed in the online shop and, in any event, before the customer submits the order.<\/li>\n\n\n\n
      3. The Seller reserves the right to change prices at any time. The price displayed at the time the contract is concluded shall apply to an order already placed.<\/li>\n\n\n\n
      4. In the event of an obvious pricing error, the Seller reserves the right to withdraw from the contract if the error was recognizable to the customer or if the displayed price was clearly incorrect. Any payments already made will be refunded without undue delay.<\/li>\n<\/ol>\n\n\n\n

        \u00a7 4 Payment<\/h2>\n\n\n\n
          \n
        1. The payment methods available to the customer are those displayed during the ordering process.<\/li>\n\n\n\n
        2. The following payment methods may currently be offered:
          • advance payment by bank transfer<\/li>
          • PayPal<\/li>
          • where available, EPS bank transfer<\/li><\/ul>The customer has no legal entitlement to a particular payment method.<\/li>\n\n\n\n
          • In the case of payment by advance payment or bank transfer, the customer will receive the necessary payment details with the order confirmation. The goods will be dispatched after the full purchase price has been received.<\/li>\n\n\n\n
          • Where a third-party payment service provider is used, its applicable terms and conditions may also apply.<\/li>\n\n\n\n
          • If payment is not received within the applicable payment period, the Seller may cancel the order after granting the customer a reasonable period for payment.<\/li>\n\n\n\n
          • In the event of default in payment, the Seller is entitled to claim statutory default interest and any necessary and reasonable costs incurred in pursuing the payment, to the extent permitted by law.<\/li>\n<\/ol>\n\n\n\n

            \u00a7 5 Delivery and Shipping<\/h2>\n\n\n\n
              \n
            1. Goods will be delivered to the delivery address provided by the customer during the ordering process.<\/li>\n\n\n\n
            2. Available delivery countries and applicable shipping costs will be stated in the online shop.<\/li>\n\n\n\n
            3. The expected delivery period will be stated in the online shop or during the ordering process. Unless otherwise agreed, delivery will take place within the stated delivery period after receipt of payment.<\/li>\n\n\n\n
            4. If delivery is delayed for reasons beyond the Seller’s control, the customer will be informed accordingly.<\/li>\n\n\n\n
            5. The Seller may make partial deliveries where this is reasonable for the customer. No additional shipping costs will be charged to consumers where the partial delivery was initiated by the Seller.<\/li>\n\n\n\n
            6. In transactions with consumers, the statutory provisions concerning the transfer of risk shall apply. The risk of accidental loss or accidental damage therefore generally passes to the consumer only upon delivery of the goods to the consumer or to a third party designated by the consumer.<\/li>\n<\/ol>\n\n\n\n

              \u00a7 6 Retention of Title<\/h2>\n\n\n\n

              1. The delivered goods remain the property of the Seller until the purchase price has been paid in full.<\/li>\n\n\n\n
              2. In transactions with consumers, retention of title shall apply only to the extent permitted by applicable law.<\/li>\n<\/ol>\n\n\n\n

                \u00a7 7 Right of Withdrawal<\/h2>\n\n\n\n

                1. Consumers generally have a statutory right of withdrawal from distance contracts in accordance with the Austrian Distance and Outward Transactions Act (FAGG).<\/li>\n\n\n\n
                2. The withdrawal period is generally 14 days. Further details and statutory exceptions to the right of withdrawal are set out in the separate Withdrawal Information \/ Right of Withdrawal Notice<\/strong> provided by the online shop.<\/li>\n\n\n\n
                3. Statutory exceptions to the right of withdrawal may apply to goods which, due to their nature, are not suitable for return or which may deteriorate or expire rapidly.<\/li>\n\n\n\n
                4. In particular, the right of withdrawal may not apply to sealed goods which are not suitable for return for reasons of health protection or hygiene and whose seal has been removed after delivery<\/strong>, where the statutory requirements for this exception are met.<\/li>\n\n\n\n
                5. Before placing an order, customers will be informed whether a right of withdrawal exists and about any applicable statutory exceptions.<\/li>\n<\/ol>\n\n\n\n

                  \u00a7 8 Warranty<\/h2>\n\n\n\n

                  1. The statutory warranty provisions apply.<\/li>\n\n\n\n
                  2. The Seller warrants that the goods are free from defects at the time of delivery and comply with the agreed or legally required characteristics.<\/li>\n\n\n\n
                  3. In the event of a valid warranty claim, consumers have the rights provided by law, including, where applicable, repair, replacement, price reduction or cancellation of the contract.<\/li>\n\n\n\n
                  4. Nothing in these GTC limits or excludes the statutory warranty rights of consumers.<\/li>\n\n\n\n
                  5. In the case of food products, customers must observe the best-before date and storage instructions stated on the respective product packaging.<\/li>\n<\/ol>\n\n\n\n

                    \u00a7 9 Liability<\/h2>\n\n\n\n
                      \n
                    1. The Seller shall be liable in accordance with statutory law for damages caused intentionally or through gross negligence.<\/li>\n\n\n\n
                    2. Mandatory statutory liability provisions applicable to consumers remain unaffected.<\/li>\n\n\n\n
                    3. Any limitation of liability shall not apply to personal injury or to damages for which liability cannot legally be excluded or limited.<\/li>\n<\/ol>\n\n\n\n

                      \u00a7 10 Data Protection<\/h2>\n\n\n\n

                      1. The Seller processes customers’ personal data in accordance with applicable data protection legislation.<\/li>\n\n\n\n
                      2. Further information concerning the processing of personal data, the purposes of processing, recipients of personal data and customers’ rights is provided in the Privacy Policy<\/strong> of the online shop.<\/li>\n<\/ol>\n\n\n\n

                        \u00a7 11 Copyright<\/h2>\n\n\n\n
                          \n
                        1. All content of the online shop, including texts, images, product descriptions, logos and graphics, is protected by copyright unless expressly stated otherwise.<\/li>\n\n\n\n
                        2. Any use, reproduction or other exploitation of the content beyond the limits permitted by law requires the prior consent of the respective rights holder.<\/li>\n<\/ol>\n\n\n\n

                          \u00a7 12 Alternative Dispute Resolution<\/h2>\n\n\n\n

                          The Seller endeavours to resolve disputes with customers amicably.<\/p>\n\n\n\n

                          Consumers may also make use of statutory consumer dispute resolution or conciliation bodies where applicable.<\/p>\n\n\n\n

                          \u00a7 13 Applicable Law<\/h2>\n\n\n\n

                          1. Austrian law shall apply, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).<\/li>\n\n\n\n
                          2. Where the customer is a consumer, this choice of law shall apply only to the extent that it does not deprive the consumer of mandatory protections granted by the law of the country in which the consumer has their habitual residence.<\/li>\n<\/ol>\n\n\n\n

                            \u00a7 14 Jurisdiction<\/h2>\n\n\n\n
                              \n
                            1. For consumers, the statutory rules concerning jurisdiction shall apply.<\/li>\n\n\n\n
                            2. For business customers, the competent court at the Seller’s registered business address shall be agreed as the place of jurisdiction to the extent legally permissible.<\/li>\n<\/ol>\n\n\n\n

                              \u00a7 15 Severability<\/h2>\n\n\n\n

                              Should any provision of these GTC be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.<\/p>\n\n\n\n

                              The applicable statutory provisions shall apply in place of the invalid or unenforceable provision.<\/p>\n\n\n\n
